Bylaw Complaints and Disputes

COMPLAINTS

Most District of Tofino bylaws are enforced on a complaint-driven basis. If you believe a bylaw is being broken, please file a complaint using the form below. A bylaw complaint is a formal request to have an alleged bylaw infraction investigated by a bylaw enforcement officer.

Anonymous complaints are not accepted.

Should this matter proceed to court, your name and other personal information may be disclosed and you may be required to give evidence as a witness.

DISPUTES

If you have received a ticket and you wish to dispute it, you can fill out the form below. You must submit a dispute within 14 days of receiving the ticket.

  • Disputed tickets are reviewed by a Screening Officer.The role of a Screening Officer is to determine whether or not an alleged offence was committed; they do not consider the circumstances of an offence.
  • If you are not satisfied with the Screening Officer’s decision about whether or not an offence was committed, you may request an Adjudication Hearing.

ADJUDICATION

The Bylaw Adjudication system allows local governments to manage most bylaw violations such as parking tickets at the local level rather than through the Provincial Court system.

  • Hearings are held in Nanaimo, B.C.
  • Evidence may be presented orally, in writing or electronically.
  • The adjudicator only determines whether or not an alleged offence was committed and does not consider the circumstances of an offence.
  • If an adjudicator determines that the contravention did occur:
    • You are liable to pay the set fine amount.
    • You are responsible for an additional $25.00 Adjudication Fee.
    • An adjudicator’s decision is final and cannot be disputed.
